LEGAL CLAUSES – SORIXCLOCK

1. Provider Identification

The SorixClock computer application is owned by SorixDigital, which acts as a technological provider and software developer, making the application available to its customers under the conditions established in this document.

2. Object of the Contract

SorixClock is an application intended for time control and recording of work clockings, including, where applicable, geolocation functionalities associated with the moment of clocking.

3. License of Use

SorixDigital grants the customer a non-exclusive, non-transferable, limited, and revocable license to use the SorixClock application, solely for their own business purposes and in accordance with these conditions.

The customer does not acquire any ownership rights over the application, its source code, design, structure, functionalities, or documentation.

4. Initial Free License and Promotions

SorixClock is offered free of charge for an initial period of thirty (30) days, counted from the date of installation, activation, or first use of the application.

Likewise, SorixDigital may grant, on a promotional, exceptional, and non-mandatory basis, free licenses of up to three (3) months in duration, without such grant generating any right to indefinite free use or expectation of continuity in the free modality.

The free license is granted "as is", without additional warranties, and does not imply a commitment to maintenance, support, updates, or continuity of the service in the free modality.

5. Right to Modify the License Model

SorixDigital expressly reserves the right to modify, update, or replace, at any time and at its sole discretion, the licensing model of SorixClock, being able to establish paid versions, subscriptions, functional limitations, commercial plans, or new economic conditions.

Such modifications:

  • Will not be retroactive.
  • Will be communicated to the customer with reasonable notice.
  • Will not oblige the customer to contract a paid version.

In case of not accepting the new conditions, the customer may cease the use of the application without any penalty.

6. Personal Data Protection

The personal data processed through SorixClock, including geolocation data, are entered, managed, and stored under the exclusive responsibility of the customer, who holds the status of data controller, in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD).

SorixDigital acts exclusively as a software provider, without accessing, storing, controlling, or processing the personal data managed by the customer through the application.

The geolocation functionality, if activated, is used only at the moment of clocking, without continuous tracking of the workers' location.

7. Customer Obligations

It is exclusively the customer's responsibility to:

  • Inform their workers about the processing of their personal data.
  • Guarantee the legal basis that legitimizes such processing.
  • Comply with current regulations on data protection.
  • Address the exercise of the rights of the interested parties.
  • Implement the necessary technical and organizational measures to guarantee data security.

8. Limitation of Liability

SorixDigital will not be responsible for the use that the customer makes of SorixClock, nor for the legal non-compliances derived from such use, nor for the sanctions, claims, or liabilities that could be imposed as a consequence of the processing of personal data carried out by the customer.

The customer expressly exonerates SorixDigital from any liability derived from the processing of personal data carried out through the application, except in case of intentional or negligent action directly attributable to SorixDigital in the strictly technical field of the software.

9. Intellectual Property

All intellectual and industrial property rights over SorixClock correspond exclusively to SorixDigital. The customer agrees not to reproduce, modify, decompile, distribute, or exploit the application outside the terms of the granted license.

10. Data Deletion and Right of Erasure

Users (employees registered by the customer) can request the deletion of their personal data at any time. Since SorixClock is a local storage application controlled by the Customer (Company), data deletion can be performed in the following ways:

  • From the application: The system Administrator can delete individual records or complete employee files from the management panel.
  • Direct Request: If the user does not have access to the application, they can contact the data controller (their company) or send a assistance request to our contact email sorixdigital@gmail.com so that we can help them manage their right of erasure with the responsible customer.

Once the information is deleted from the application's local database, the data disappears permanently and cannot be recovered.

11. Acceptance

The installation, activation, or use of SorixClock implies full and unreserved acceptance of these clauses.
